TERMS & CONDITIONS

"Cancellation Policy – Due to the difficulty involved with scheduling, all bookings are final.

Refusal - We have the right to refuse service to any client at any time. We reserve the right to cancel a reservation at any time without penalty provided we issue a full refund. This is the only circumstance under which a refund may be acquired by the client.

Limitation of Liability –

· Liability: TravelCostaRicaNow.com, (from now on be known as TCRN) Michael Alan Skofield and D'angelo Valentin function solely as a marketing agent for the tour/attraction owners and as such limits its liability, individually and collectively, to the agency fee charged to the owner. This amount is not to exceed 10% of the fees collected from the client(s) by TCRN on the tour/attraction owner’s behalf. Any additional remedy must be sought directly from the tour/attraction owners whose contact information shall be provided.

· Products and Services Booked by TCRN: Due to the fact that some activities involve a degree of risk, (for example risk of fall while horseback riding etc.) TCRN assumes no liability related to the purchase or use of them. This includes but is not limited to services booked by TCRN on behalf of the client(s), services provided directly to the client(s) by TCRN and/or any other products or services booked or arranged by TCRN on behalf of the client(s). The use of additional products or services purchased through TCRN, whether provided by TCRN or a third party, is entirely at the client(s) discretion and risk. The client(s) hereby releases TCRN from any and all liability related to additional products and services purchased through or provided by TCRN.

· General Liability: Part of Costa Rica’s charm is that it is still a developing country. This adds to its beauty but makes the provision of public services less than perfect, particularly during the rainy season. For instance storms can lead to power surges or failures and other interruptions of services. They can also lead to cancellation of pre-paid, non-refundable activities such as fishing or horseback riding excursions. TCRN can not be held liable for service or product interruptions resulting from acts of god or factors outside of our/their control such as damage to property such as electronic devices, interruption of municipal services, the reduced use of property or other interruption or loss of service. The client(s) hereby agrees to hold TCRN and its employees harmless in the event of disruption of services regardless of whether the product or service in question is provided directly by TCRN or by a third party.

In layman's terms. Travel Costa Rica Now is michael alan and D'angelo. We are merely a broker between you the client(s) and the tour company. We provide this service so you can have a great time in Costa Rica without it costing an arm and a leg. The money you pay TCRN goes directly to the tour company providing the service, excluding a small commission. This is why we have a NO REFUND POLICY, because we don't keep your money, accept like mentioned above, a small commission.

To make our clients’ trip more enjoyable and safe, we’d like to tell you about some of our policies for our exciting adventures:

• Desafío Adventure Company also reserves the right to cancel any trip due to unsafe conditions and will only run a tour according to established company policies. Full refund is given if (on rare occasion) no tour is run. For reasons beyond our control (climate, river levels, etc.), we may change to a more-suitable tour with an equal or similar difficulty rating and adventure-appeal or offer other options so you don’t miss out on a fun day in Costa Rica. Our Head Guide helps make the final decision.

• Rafting, canyoneering and many of our other adventures involve some inherent risk and physical exertion, so you must be in good physical condition without any recent surgery, heart condition, pregnancy or injury. If you take medication such as allergy pills and need them with you or have other medical concerns, please inform the guide.

• The natural environment of Costa Rica is filled with insects, snakes, crocodiles & other wildlife. In addition, landslides, falling rocks & sudden flash floods are possible. We may not be held responsible for an encounter with any of the above.

• Desafío Adventure Company has a $1-million civil responsibility insurance policy, a contract with a specialized paramedics company and our guides and drivers are trained in first aid and CPR in case of emergency. However, we highly recommend you have your own travel insurance with a reputable company prior to participating in a tour. Please ask us for travel insurance options.

• Recommended ages for tours operated by Desafio: Río Toro class 3-4: 13-55; Río Balsa class 2-3, & Venado Caves: 10-65; Canyoneering in the Lost Canyon & Cerro Chato: 13-55; Stand Up Paddling, Safari Float & nature walks (Arenal Volcano, Hanging Bridges, Río Celeste, Nature Combo 6x1): 6-66+; Horseback riding: 8-55; Community, Culture & Conservation or Proyecto Asís & Luna Nueva: no age limit (under 5 free.) For those outside of the age recommendations or if there is an adult accompanying a child, we ask that clients request & sign a special Waiver for such cases. Most tours require 2 pax minimum.

• The max. weight limit for whitewater rafting, canyoneering & horseback is 200 lbs. We may also cancel any client seen unfit to do a tour for their own safety and/or the safety of clients and guides. Clients must not be under the influence of drugs or alcohol.

• We recommend closed shoes for hikes, horseback & canyoneering. Clients should know how to swim & feel comfortable in water.

• Do not take valuables on tours such as jewelry, passports, etc. Desafío Adventure Company & its affiliates are not responsible for lost, broken or stolen items. We have a lost & found box for tours & services & donate items after 2 weeks left behind.

• Please be ready at the given pick-up time and allow time for road conditions and other clients being picked-up along the way. If you have not been picked-up within 10 minutes of your established pick-up time, please call our office.
